- Scope and acceptance
These Terms and Conditions of Sale govern purchases of products available through deatrium.com.
Customers are invited to read these terms carefully before placing an order. By submitting an order, the customer confirms that they have read and accepted them.
All mandatory consumer rights provided by applicable law remain unaffected.
- Products
De Atrium selects and offers home accessories, textiles, ceramics, home fragrances, artworks and other decorative objects.
Product images and descriptions are provided to represent each item as accurately as possible. However, colours and proportions may appear slightly different depending on the screen used.
Certain products are made or finished by hand and may display slight variations in colour, shape, texture or finish. These variations are inherent characteristics of the workmanship and are not considered defects, provided that they do not affect the conformity or intended use of the product.
- Prices and taxes
Prices are indicated in the currency displayed on the website and confirmed during checkout. Unless otherwise stated, prices include applicable taxes.
Shipping charges and any other applicable costs are displayed before the order is confirmed.
De Atrium may change its prices at any time. The price applicable to an order will be the price displayed when the order is submitted.
If there is an obvious error in a product’s price or commercial information, De Atrium will contact the customer before proceeding with the order. The customer may confirm the purchase at the correct price or cancel it and receive a full refund of any amount already paid.
- Orders and conclusion of the contract
To make a purchase, the customer must follow the checkout process and provide complete, accurate and up-to-date information.
Before submitting an order, the customer can review the selected products, total price and any shipping charges and correct any errors.
After submitting the order, the customer will receive confirmation at the email address provided. The sales contract is concluded when De Atrium sends the order confirmation.
If a product is exceptionally found to be unavailable after the order has been confirmed, De Atrium will promptly inform the customer and refund the full amount paid for the unavailable product.
De Atrium may refuse or cancel an order in the event of invalid payment information, a reasonable suspicion of fraud, product unavailability or an obvious error in the commercial information. If an order is cancelled, any amount already collected will be refunded.
- Payments
The payment methods available are displayed during checkout and may include major credit and debit cards, PayPal and other payment systems made available through Shopify.
Payments are processed through secure payment service providers. De Atrium does not directly store complete payment card details.
Products remain the property of De Atrium until payment has been received in full.
- Shipping and delivery
Orders are prepared in Milan and are normally dispatched within 3–5 business days.
Available destinations, shipping rates and any free-shipping thresholds are displayed on the website and during checkout.
Delivery times may vary depending on the destination, carrier and type of product. Any delivery times shown on the website are estimates unless an essential delivery date has been expressly agreed.
The customer is responsible for ensuring that the delivery address provided is complete and accurate. De Atrium is not responsible for delays or additional costs directly caused by incorrect or incomplete information supplied by the customer.
For purchases made by consumers, the risk of loss or damage passes to the customer when the product is physically delivered to the customer or to a person designated by them.

- Right of withdrawal
Consumers may withdraw from their purchase without giving any reason within 14 days from the date on which they, or a person designated by them, take physical possession of the products.
To exercise the right of withdrawal, the customer must communicate their decision within this period by writing to support@deatrium.com and indicating the order number and the items to be returned.
After giving notice, the customer must return the products within the following 14 days.
The item must be returned intact and, where possible, in its original packaging. The customer is responsible for any diminished value resulting from handling beyond what is necessary to establish the nature, characteristics and functioning of the product.
Return shipping costs are borne by the customer. De Atrium may provide a return label, the cost of which will be communicated to the customer and deducted from the refund.

De Atrium will issue any refund due to the payment method used for the purchase. If the right of withdrawal is exercised for the entire order, any initial standard delivery charges will also be refunded. Additional costs resulting from the choice of a delivery method other than the standard option will not be refunded.
The refund will be issued within 14 days of receiving notice of withdrawal. De Atrium may withhold the refund until the products have been received or until the customer provides evidence that they have been returned, whichever occurs first.
We do not offer exchanges.
A handwritten gift message requested by the customer does not constitute personalisation of the product and does not limit the right of withdrawal.
- Damaged or non-conforming products
Customers are invited to inspect products upon delivery and promptly report any damage, defect or error in the order by contacting support@deatrium.com.
To verify the issue and submit a possible claim to the carrier, De Atrium may request photographs of the product, its internal and external packaging and the shipping label, together with any further information reasonably necessary. Customers are invited to retain the product and all packaging until the assessment has been completed and not to dispose of them before receiving instructions from De Atrium.
De Atrium may require the product to be returned or made available for collection and inspection. If the product is found to be damaged, defective or non-conforming, its return or collection will be arranged at no cost to the consumer.
Prompt notification facilitates the assessment and any claim made against the carrier but does not limit the consumer’s rights under applicable law.
Following the appropriate checks, De Atrium will provide the remedies required by law, which may include, where applicable, repair, replacement, a price reduction or a refund.
- Legal guarantee
Consumers benefit from the statutory legal guarantee of conformity provided by applicable law.
For products purchased by consumers in the European Union, the legal guarantee generally applies for two years from delivery, without prejudice to any longer mandatory protection applicable in the consumer’s country of residence.
The legal guarantee does not cover ordinary wear and tear, damage caused by improper use, accidents, failure to follow care instructions or unauthorised alterations.
Natural variations resulting from materials and artisanal workmanship are not considered defects when they do not affect the product’s conformity.
- Intellectual property
The website’s content, including its text, photographs, images, trademarks, logos, graphics, product names and other materials, belongs to De Atrium or is used with the permission of the relevant rights holders.
Such content may not be reproduced, distributed, modified or used for commercial purposes without prior written authorisation.
- Use of the website
Customers agree to use the website lawfully and not to engage in any activity that could compromise its operation, security or accessibility.
De Atrium endeavours to keep the website available and up to date but does not guarantee uninterrupted or error-free access at all times.
- Liability
De Atrium does not limit or exclude its liability where doing so is prohibited by law, including in cases of fraud, gross negligence, personal injury or infringement of mandatory consumer rights.
To the extent permitted by law, De Atrium is not responsible for delays or failures caused by events beyond its reasonable control, including transport disruptions, natural events, actions by public authorities, conflicts, strikes or serious failures affecting networks or service providers.
- Personal data
Personal data is processed in accordance with applicable data protection legislation.

- Amendments to these terms
De Atrium may update these Terms and Conditions of Sale to reflect legal or operational changes or modifications to the services offered.
Each order is governed by the terms in force when the order is submitted. Subsequent amendments do not affect orders already concluded.
- Applicable law and disputes
These terms are governed by Italian law.
If the customer is a consumer residing in another country, the choice of Italian law does not deprive them of any mandatory protection granted by the law of their country of residence.
Any dispute involving a consumer will be subject to the jurisdiction of the courts of the consumer’s place of residence or domicile where required by applicable law.
